Here’s the Not So Fine Print

The *Wash-A-Week* program, herein after referred to as “waw” is available to any vehicle that is less than 7 feet in height and can be safely washed in the touchless automatic wash bay at Conserve Car Wash. Hydrokinetic EFX LTD a New Hampshire corporation is the owner of Conserve Car Wash and for all legal purposes contained within this contract the corporation will be referred to as Conserve Car Wash.

Set-Up Fee

The set-up fee is only $5.00 which covers the cost of the “REACH FREE IDENTIFICATION” herein after referred to as the “RFID” tag that is applied to your vehicle window. The program is only for one vehicle per RFID tag. You may not use the RFID tag to obtain a wash for any vehicle other than the vehicle it is affixed to. Any misuse of the RFID tag will result in the cancellation of your RFID tag and no refund will be issued for that months charges. Further, any attempt to remove the RFID tag from the vehicle and use it to obtain a wash for another vehicle may constitute a Theft of Services or False Representation criminal charge against you. Conserve Car Wash reserves the right to not reissue any future RFID tags to anyone who has removed a RFID tag without the consent of Conserve Car Wash.

Changing Cars or Windshields

The RFID tag is designed to be tamper proof, meaning that if it is removed from the glass it was originally affixed to it will crack the delicate printed circuit contained within the tag. If the tag were ever removed without damage you would still be liable for any washes purchased with it on your account. There is a safety default of one wash per day per tag that will limit your liability until you notify Conserve Car Wash that your tag may have been stolen. This limit may be lifted if you would like to wash your vehicle more than one time per day by signing the unlimited waiver of the contract.You may obtain a new RFID tag for your existing account for free if the old tag is removed by an authorized employee of Conserve Car Wash. If you are trading your car, stop in before you trade it, and then come in with your new car and we will place a new RFID tag on your new car. The same applies for windshield replacement. Unless the old RFID tag is returned to Conserve Car Wash you will be charged $5.00 for a new tag and a new account will have to be created.

Automatic Renewal

By joining the WAW program you understand that your membership will be renewed automatically and indefinitely on the first day of each month until cancelled by you. No full or partial refunds will be given once the monthly charge has been processed. Lack of use of the program will also not entitle the program user to any refund. Conserve Car Wash will not issue any credit if the Touchless Automatic wash is not available due to power failure, required maintenance of the equipment or any other delay beyond the control of Conserve Car Wash unless such a delay exceeds 5 calendar days of the month. Conserve Car Wash may at it’s descretion substitute a wash of equal or greater value in the Self Service Bay, by providing the user with operating time, or washing the vehicle enrolled in the program in the automatic cloth car wash.

Additional Washes

If you would like to wash your vehicle more than 6 times per month, you are all set. Additional washes will be billed to your credit card at the same low rate. Example: John Smith washes his car 8 times in the month of January and he has the basic wash program, John is charged $29.95 for his monthly base fee and $4.99 x 2 = $9.98 additional for a total of $39.93 for that month.

Cancellation

If for any reason you are unsatisfied with the WAW Program, you may cancel your membership anytime, online, 24 hours a day. There is no fee to cancel.

Monthly Rate

The WAW program will be charged monthly according to the Automatic Charge Authorization. The monthly rate will be either $29.95, $34.95 or $39.95 per vehicle, depending upon which program you select, and will be automatically charged to your credit card on the first day of each month. After the monthly rate has been paid in full, the WAW program entitles the customer to up to 6 washes per month. Payment shall be in advance thereafter on the first day of each month.

Automatic Charge Authorization

I understand that by subscribing to the WAW Program, and by signing this Agreement, I will continue to be charged the Monthly Rate indefinitely unless I discontinue as per the Discontinuation Policy and Procedure (see below). All monthly charges permitted under this Agreement will be made on the first day of each month. I agree to make payments of the Monthly Rate and all other charges permitted under this Agreement.

Charges Not Paid

From time to time, I may exceed 6 washes per month. I understand that, if I or anyone driving one of my vehicles registered under the WAW Program visits Conserve Car Wash and incurs a charge not included as part of this Agreement, my credit card will be charged immediately the full amount of that additional charge(s).

By signing this Agreement, I hereby permit such charge(s) to be paid as they are incurred.

Denied Charge Cards

I understand that, if my credit card is denied for any reason on any given month, Conserve Car Wash shall continue to attempt to charge my credit card the Monthly Rate as per the Automatic Charge Authorization. I understand that allowing my credit card to be denied, canceling my credit card, allowing my credit card to expire, or any other such action that shall prevent Conserve Car Wash from charging my card as per the Automatic Charge Authorization does not constitute Discontinuation as per this Agreement and I shall be responsible for each Monthly Rate until such time that I terminate as per the Discontinuation Policy and Procedure defined herein.

Changing Vehicles

I understand that I may change vehicles enrolled in the WAW Program at any time. Once a vehicle has been enrolled in the WAW Program and then changed to another vehicle on the same account, that new vehicle may not be deactivated until 30 days has expired from the original vehicle change date. I agree to affix a new bar code to the new vehicle. If the new vehicle becomes damaged after enrollment, I acknowledge that Conserve Car Wash reserves the right to request that I sign a waiver of damage claim if I still want to wash the vehicle.

Updating Information

I understand that I may change, revise or update information at any time, for any reason, via any of the methods as described in Contact.

Discontinuation Policy and Procedure

I understand that I may discontinue my subscription to the WAW Program at any time, for any reason. I further understand that discontinuation of my subscription does not entitle me to full or partial refunds or credits for any reason. I understand that there will he no refunds of payment once they have been processed by Conserve Car Wash. I understand that to discontinue my subscription to the WAW Program, I must first contact Conserve Car Wash via any of the methods described in Contact.

I understand that, upon notice of my discontinuation of the WAW Program subscription, all Program Benefits will be terminated 30 days from date of my last subscription payment. I understand that, if I have prepaid for the WAW Program several months in advance, no amount will be refunded or credited if my notice of discontinuation occurs prior to the period covered by that pre-payment.

Right to Discontinue

Conserve Car Wash retains the right to discontinue my participation of the WAW Program for any reason including but not limited to misconduct, disorderly behavior, verbal or physical abuse of the staff, reckless driving or speeding (exceeding 5 miles an hour) on our premises.

Rate and Contract Changes

I understand that I may update information at any time, for any reason via any of the methods as described in Contact. The terms and conditions of this Agreement, including Monthly Rate and Program Benefits may be changed by Conserve Car Wash upon thirty (30) days advance notice. Such notice shall he posted in a conspicuous manner at the front desk or may be emailed to the participant of the program.

Minimum Participation Age

I understand that I must he at least eighteen (18) years of age to participate in the WAW Program. I may, however, be of any legal driving age to bring a vehicle to Conserve Car Wash that is registered under the WAW Program. I understand that it is the vehicle that will be registered under the Program, and not the driver.

Disputes

To expedite the resolution of any charge dispute, all disputes should be addressed to Hydrokinetic EFX LTD d/b/a Conserve Car Wash, Every effort is made to resolve such disputes quickly and fairly in accordance with the terms and conditions permitted under this Agreement. If the dispute cannot be resolved within 30 days the parties will agree to participate in binding mediation.
